Non-Combatant Fatalities

Restricted Israeli data shows that the vast majority of Palestinian detainees from Gaza who lost their lives in jail were non-combatants, based on a related investigation.

In May of this year, a military intelligence database tracking all combatants in Gaza, a registry of over 47,000 named individuals, recorded just 21 deaths in custody. By that date, 65 Palestinians from Gaza had lost their lives in detention.

Prison Situation

Physical violence, mistreatment, and other abuse of detainees from Palestine has been normalised across Israel’s detention facilities over 24 months of hostilities. Senior officials have openly admitted starvation rations and an below-ground detention center detaining Palestinians who never see daylight.

Present and past detainees and informants from the armed services have collectively claimed widespread breaches of international law.

Organized Maltreatment

The organized mistreatment was accompanied by a disturbing rise in casualties recorded across a minimum of 12 civilian and military facilities in Israel. Over ten years preceding the hostilities, there were typically a couple casualties a year.

“This does not represent only a single occurrence here and there. It is widespread and it is expected to endure,” an official stated, in part due to the fact there is a climate of almost complete immunity for fatalities and maltreatment of Palestinian individuals.

Just one case of beating prisoners has proceeded to court, with the soldier sentenced to 210 days. “While these policies continue to be enforced, every Palestinian in detention is at peril, also the physically well individuals, even the youth who have no underlying conditions.”

High-Profile Cases

Several casualties in confinement have been high profile, such as a 50-year-old medical chief who lost his life in prison after 120 days in custody.

A detainee incarcerated with the individual stated that he was brought to the yard by prison staff shortly before his death, visibly injured and naked from the waist down. His body remains unreleased to Gaza.

Other prisoners who died in Israeli custody remain anonymous. Correctional authorities and military supplied analysts with the figure of deaths in detention, and minimal other details including the facility where they perished, but excluding the detainees’ identities.

Documentation Problems

In 21 cases, mostly people from Gaza, analysts were unable to match the minimal data supplied by government bodies to a casualty recorded by rights organisations, by means of accounts from former inmates or reporting in the media.
